The Department Energy and Environmental Protection (DEEP) announced a new enforcement policy that will provide broad leniency to regulated entities that encounter “extenuating circumstances” associated with the COVID-19 emergency that would prevent you from fully complying with state environmental laws.
DEEP recommends that if you need relief from laws and environmental regulations that you document them in detail and communicate them in writing with DEEP as soon as practicable concerning your inability to achieve compliance. In the event that a you become aware that you did not or may not comply in a timely fashion with any laws, including a license (permit, approval, registration, etc.) issued by DEEP, you need to document your compliance shortcomings and provide written notification to DEEP.
